Welcome to "Capybara Spanish" (hereinafter referred to as "the App"). Please read these Terms of Use carefully before using the App. By downloading, installing, or using the App, you agree to be bound by these Terms of Use.
1. Service Description
1.1 App Features
The App is a Spanish language learning application that provides:
- Spanish alphabet learning
- Vocabulary flashcard learning
- Interactive quizzes
- Learning progress tracking
- Achievement system
1.2 Scope of Service
The App is intended for educational purposes only and does not guarantee that users will achieve any specific level of language proficiency. Learning outcomes vary by individual.
2. Eligibility
2.1 Age Requirements
The App is suitable for users of all ages. Minors should obtain consent from a parent or guardian before using the App.
2.2 Device Requirements
The App is only available for iOS devices (iPhone and iPad). You need a compatible device and operating system version for proper functionality.
3. User Accounts
The App does NOT require account creation or login. All learning data is stored locally on your device.
4. Subscription Services
4.1 Free Content
The App provides some free content, including:
- Complete Spanish alphabet learning (27 letters)
- Basic vocabulary (Greetings, Numbers)
- Basic quiz features
4.2 Capybara Pro Subscription
Subscribing to Capybara Pro unlocks:
- Full vocabulary library
- Advanced learning categories (Travel, Food, Daily life, Culture)
- Ad removal
- Future course additions
4.3 Subscription Terms
- Subscriptions are processed through the Apple App Store
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Payment will be charged to your Apple ID account upon confirmation of purchase
- You can manage or cancel subscriptions in your App Store account settings
- After cancellation, you may continue to use paid features until the end of the current period
4.4 Refund Policy
All purchases are subject to Apple App Store refund policies. To request a refund, please contact Apple Support.
5. Intellectual Property
5.1 Copyright
The App and its content (including but not limited to text, images, audio, design, and code) are protected by copyright law.
5.2 Trademarks
The "Capybara Spanish" name, capybara mascot, and related logos are trademarks of the App.
5.3 License Grant
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.
5.4 Prohibited Actions
You may not:
- Copy, modify, or distribute App content
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices
- Use the App for any commercial purpose
- Use automated tools to access or extract App content
6. User Conduct
6.1 Lawful Use
You agree to use the App only in lawful ways and in accordance with these Terms.
6.2 Prohibited Misuse
You may not:
- Attempt to interfere with or disrupt App operations
- Circumvent any security measures or access restrictions
- Use the App for any illegal activities
7. Disclaimers
7.1 As-Is Provision
The App is provided on an "as is" and "as available" basis without any warranties, express or implied.
7.2 Learning Outcomes
We do not guarantee any specific learning outcomes from using the App. Language learning results depend on individual effort and various factors.
7.3 Content Accuracy
While we strive to ensure the accuracy of learning content, we do not guarantee that all content is error-free. If you find any errors, please report them.
7.4 Data Loss
Since data is stored locally only, we are not responsible for data loss due to device failure, app deletion, or other causes.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the App.
9. Service Changes
We reserve the right to modify, suspend, or terminate the App (or any part thereof) at any time without notice.
10. Modifications to Terms
We may modify these Terms of Use from time to time. Modified terms will be posted within the App. Continued use of the App constitutes acceptance of the modified terms.
11. Termination
We reserve the right to terminate or restrict your access to the App if you violate these Terms of Use.
12. Governing Law and Jurisdiction
These Terms of Use are governed by the laws of the Republic of China (Taiwan). Any disputes arising from these Terms shall be subject to the jurisdiction of the Taipei District Court in Taiwan.
13. Severability
If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms of Use (together with the Privacy Policy) constitute the entire agreement between you and us regarding the use of the App.
